1. Acceptable Use

You agree not to use the Platform to:

• Post false, misleading, or fraudulent content
• Harass, abuse, or harm other users
• Violate any applicable laws or regulations
• Scrape or harvest data without permission
• Interfere with or disrupt the Platform
• Distribute malware or harmful code
• Impersonate another person or entity
• Circumvent any access controls or security measures

2. Employer Terms

Employers using the Platform agree to:

• Post only genuine, available job opportunities
• Not discriminate in hiring based on race, color, religion, sex, national origin, age, disability, or any other protected characteristic
• Include an EEO statement in all job postings as required by law
• Maintain candidate data securely and delete it when no longer needed
• Use candidate data only for legitimate hiring purposes
• Comply with all applicable employment and privacy laws

3. Candidate Terms

Candidates using the Platform agree to:

• Provide accurate and truthful information in their profile and applications
• Not misrepresent qualifications, experience, or identity
• Apply only to roles for which they are eligible
• Respond professionally to employer communications
• Not use the Platform to conduct competitive intelligence or solicitation

4. Billing and Subscriptions

Paid features are billed in advance on a monthly or annual basis. Subscriptions auto-renew unless cancelled before the renewal date. All fees are non-refundable except as required by law. We reserve the right to modify pricing with 30 days' notice. Failure to pay may result in suspension of premium features.

5. Intellectual Property

All Platform software, design, and content (excluding user-generated content) is owned by HireGenix or its licensors. You retain ownership of content you submit (resumes, profiles, reviews) and grant HireGenix a non-exclusive, worldwide licence to use, store, and display that content in connection with providing the Platform.

The HireGenix name, logo, and brand elements are trademarks of HireGenix. You may not use them without prior written permission.

6. Disclaimer of Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HIREGENIX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE PLATFORM. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO HIREGENIX IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. You may delete your account at any time via your account settings. Upon termination, your right to access the Platform ceases immediately.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of courts located in Delaware.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or via a notice on the Platform. Continued use after changes become effective constitutes acceptance of the revised Terms.
